Estate and Incapacity Planning
We are committed to empowering our clients with their Estate and Incapacity Planning. Even though most of us agree that “Planning for the Un-planned” makes absolute sense, most of us don’t have this at the top of our “To Do List”. It is no doubt human nature to think that we will have the time to plan … Later.
Yet, to many of us, the Unplanned or the Unthinkable comes unannounced. It is always painful to see how “not having things in place” causes at that most challenging time, overwhelming added stress and anxiety. Therefore, we are committed to empower our clients to dare to engage in the conversation, be informed and be pro-active.
We are very fortunate to live in a country, a Province and a Legal/Health Care environment that allows us, individuals, to make our OWN decisions when it comes to our Estate and our medical/personal well-being. In recent years, the Law has undergone significant changes to stay in tune with the medical, social and legal reality of today’s society.
Documents that need to be signed under Oath or copies that need to be certified are often called notarizations.
In the case of certified true copies, you can come during business hours with the original document and we will take a copy and certify it to be a true copy.
In the case of documents to be signed under Oath (often called Affidavits or Statutory Declarations), the person to sign this document has to come in person with the document or form and 2 pieces of valid government-issued ID. When signing in our presence, we will certify that you were in our office at that time, signed in front of us and were properly identified.
In either case, no appointment is necessary unless you want peace of mind or don’t want to wait in case there are people ahead of you.
Whether you are buying, selling or re-financing a property in the province of British Columbia, I can help.
If you are buying, I will require a copy of the purchase contract from your realtor and, if you are buying with a mortgage, mortgage instructions from your broker or lender.
If you are selling, I will require a copy of the sale contract from your realtor. And if you are re-financing your property, I will require mortgage instructions from your broker or lender.
Based on those documents, I will prepare all necessary legal documents and calculations which I will review with you at a meeting close to the completion date. That is the date the ownership of the property is conveyed or transferred and/or the mortgage is funded.
